would not return my battery and sold me the wrong one

On August 20, 2015 I drove into the Advance Auto Parts store # 09141 (239) 495-1818 ... Located at 27791 S Tamiami Trail Bonita Springs, FL 34134 because I have been a long time customer (since 2008 in FL) bought two car batteries from the company and was worried about corrosion on top of my battery post & terminal.

After the computer program ticket test was performed I was told the battery is still good, but needs a charge to continue testing it to see if it can be replaced under warrantee.

The battery was unhooked remover without incident by two of the companies employs and taken in the back room on a cart to be charged and never to be seen again.

The employee who did remove it (Gustavo E) went to the computer and started to look up my information ... I explained I bought the first battery on the East Trail in Naples FL four years ago w/ a five year warrantee and two years ago his store (same as above) replaced it w/ a new one because the one originally bought was defective.

The employee called the Naples store and did find the sale information and confirmed by tell me my old NJ phone number as well.

He then explained in short that there is no warrantee on this battery and could not pro-rate it either and I have to buy a new battery.

I questioned why and he became angry he kept rolling his eyes at me and speaking derogatory towards me and I felt very uncomfortable.

I requested my battery be re-installed into my car and I'll be on my way and he would not comply in part by telling me he was unable to charge it and it was now broken.

I called AAA to see if they would assist me but were unable so I called my local car repair shop and he was leaving for the day so I was forced to buy a battery from this un honest person and have him install it too!

When he started to install it I told him I needed a bigger battery and he refused to listen and ended up putting in the wrong battery (too small) I asked him three times and he ignored me each of the times. I had to beg him to sell me a there year warrantee instead of the two year one he first pulled out.

This was turning into a nightmare and I was being bullied, intimidated and was certainly afraid for my safety.

Less than three week later the battery started to spill acid and corrode again so I called the store above and spoke w/ the manager Alberto C. He apologized and invited me back down there to resolve the problem and so I did.

11AM I pulled into the parking lot of the store above but not before calling the Lee County Sherriff's Department to see if I can request a "Stand-By Officer" incase they were to act out of control again and cause me any additional stress, LCSD said they would come in if I felt afraid.

I introduced my self to the manager and for one whole hour he was explaining company policy & procedure to and agreeing that no customer should have been put through that and was able to resolve it today.

He bargained back and fourth w/ me until he agreed to remove the incorrect battery that I paid $145.30 for and upgrade to the correct battery ($5.00 difference) at no charge to me PLUS a $50.00 credit for the $20.00 core discount that the first employee did not give me and because there was NOTHING wrong w/ the first battery to begin with.

GM Alberto C. Made me continued to wait an extra fifteen minutes in 91 degree direct sun for a total of ONE HOUR just to walk out of the store and say to me ... Sorry I can't credit you the $50.00 I told you I would ... It's now $25.00 take it or leave it. I was disgusted and requested For him to honor in writing on my receipt that he would refund the $145.30 PLUS $20.00 core value and drove away.

I am ordering a new terminal and battery from LEXUS and will return the third BAD battery for a refund.

I would also like the reimbursement of the GOOD battery that they hid from me and claimed it was broken. This was untrue and would not return it to me on 08/20/15 nor today 09/03/15.

PLEASE help ...Thank you,
