ESCROW REFUND

Its been over a month (+30 Days) I sold property and paid off loan to CENLAR and no official refund from Escrow account. It began when servicing from PlainsCapital Bank to CENLAR. Closing date of Sale had to be moved to later in the month due to the "black out period" the transition of servicing and they were not able to provide payoff. It took over a 3 week to obtain an official payoff and of course, CENLAR, was unable to backdate interest. Loan closed and Title Co. wired payoff; I called the day after to confirm full payment was received and to verify escrow balance. I was told escrow refunds would be 20 working days after payoff; which is insane since they are so called experts in mortgage servicing. so, patiently I waited for 32 calendar days and finally got a check in the mail. Took check straight to my Bank but was rejected due to routing # and account # not matching and most likely it was fraudulent. Told teller it was impossible since check was coming from my Mortgage Company. Teller suggested that I take check to PlainsCapital Bank since the top of the check had its logo. Drove straight to PlainsCapital Bank, teller had the same expression and confirm what the other bank stated. teller tried several times to confirm routing or account # and their system was also rejecting check and asked that I call CENLAR how to proceed.

I called CENLAR and ask them what was wrong with their check. they stated "it must have been a typo, but we will overnight a check to you". waited two more days and still no check; called them again to ask for a supervisor and stated I will not get one until next month, which would make it over 40 days with no escrow refund. CENLAR hires Manager/ supervisor with no basic knowledge of a mortgage; she said it was not my money and why rush it to me. I had to explain basic information on most mortgages and how when most people make a payment that includes taxes and insurance. so, when funds are accumulated in escrow and not paid out, funds should be sent to borrower; so, ultimately making the borrower's money. CENLAR is a really disorganized organization.

I never paid late or paid any late fees but they do have a policy that would have charged me late fee if I did not pay after grace period. I asked them to add 5% late fee due to their delay in sending refund and $35 for sending a bad check. my request was declined since I'm just a consumer :( and have no rights.

now, I have a check that they might as well wrote on a sticky and still waiting.
