JIHAD KAOUK

Many complaints have been filed against Jihad Kaouk and Cleveland Clinic Foundation with CMS, The Joint Commission, American Board of Urology, the State Medical Board of Ohio, Cuyahoga County Court, and Federal Courts for medical fraud and devastating permanent surgical injuries. Substantiated complaints include -- Non-board certified staff surgeons; no credentialing requirements or certification for staff surgeons or residents; no signed patient informed consent documents; blank surgeons’ attestations that surgeon was present during the critical portions of surgery; same day surgery verification of patient consent document blank and/or signed months after surgery; surgical op notes signed months after surgeries; concealment of blood loss, complications, and identity of surgeons performing surgery; op notes written in third person; misrepresentation of fact to CMS investigators; failure to report operating room fires; failure to report or document burns to patients; no privileging of staff or residents for use of the defective da Vinci robot; false representation of the safety and efficacy of robotic surgery; false representation of volume experience, surgical outcomes, and credentials of surgeons; patients’ rights violated. Jihad Kaouk was a paid agent of Intuitive Surgical Inc, manufacturer of the da Vinci robot and, only after November 2008, passively informed patients of this conflict of interest on the CCF website. He admitted to CMS investigators that only "one-third" of patients recover sexual function after his robotic prostatectomies. Findings also determined Jihad Kaouk was scheduling multiple simultaneous surgeries beginning within minutes each other twice per day. Nine CMS investigations resulted in letters sent to CEO Cosgrove stating, “WE HAVE DETERMINED THAT THE DEFICIENCIES CITED ARE SIGNIFICANT AND LIMIT YOUR HOSPITAL'S CAPACITY TO RENDER ADEQUATE CARE AND TO ENSURE THE HEALTH AND SAFETY OF YOUR PATIENTS.” Jihad Kaouk has been under investigation by the State Medical Board of Ohio since 11 August 2011. Leapfrog Group awarded THE FIRST EVER “D” RATING to the Cleveland Clinic Foundation for hospital safety in 2012. LEAPFROG, AND CONSUMER REPORTS, GOT IT RIGHT!
