Services sold on presentation of misleading and false information

On 3rd April 2015 we were deceived into signing an agreement with Karon Resort Club and Resort in Phuket whereby we paid a deposit of USD $6750 comprising of THB147489.00 from my Visa card and AUD $3000 in cash.

What this club is selling is not what will be provided. They have offered UNLIMITED BONUS WEEKS at $299AUD for a 30 year period and basically they offer ANYWHERE-ANYTIME. They also advised that we will have an account at Dial an Exchange and this is where we will purchase our weeks. However what they failed to tell us is that the UNLIMITED BONUS WEEKS can only be bought a maximum of six weeks in advance and the availability is almost nil and is not the 4 to 5 star- standard which they offered, yet this “Agreement” states we can book accommodation up to one year in advance. When the salesperson took us through the computer presentation and demonstration of the Dial an Exchange website, he did not search for bonus weeks but instead searched for and showed us EXCHANGE WEEKS which is an entirely different concept with much more availability.

On our return to Australia we obtained all this information from Dial an Exchange and they have confirmed that we will only be entitled to BONUS WEEKS that are only available to book up to a maximum of 42 days in advance with very limited availability. DAE also provided us with a specific description of what a bonus week is in writing.

Unfortunately, their sales people did not disclose any of this information to us and we have been deceived into paying USD $13000 (approx AUD $19,000) for a product that is offered free by DAE with free membership and from RCI at a cost of $300 per year. Their sales people also do not disclose that since DAE has been operating and offering BONUS WEEKS, there has never been overseas availability as bonus weeks as these weeks are already consumed by normal timeshare exchanges. Their sales are based on deception.

Bottom line, Karon Beach Club and Resort are selling vacations to people that will never be available. They hide behind their "subject to availability" clause in your “Agreement Terms”. As specified, we have since become aware that during the presentation we attended and were fraudulently “sold on”, the salesperson navigated through the "exchange" section of the website which is for timeshare week owners only that showed a huge amount of availability and possible exchanges years in advance. Also as specified, DAE have since explained to us that they were searching in the wrong section of the website and that they should have been looking at "bonus weeks" section. This strongly suggests a deliberate deception on KBCR's part.

We have since become aware of other “victims” of this membership who have been waiting over a year for their booking confirmation with no success, being placed on a perpetual “waiting list”.

We have paid AUD $3000 to them in cash and I believe that the Direct Sales and Direct Marketing Act (2002) Thailand allows a 7 days compulsory cooling off period on contracts signed in Thailand.

Karon Beach Club and Resort did not inform us of this "Cooling Off period which I believe is required with any “legitimate” contract. As I understand it when a deposit or payment in full is made we should with the copy of the agreement receive a copy of the details of the Cooling Off Period, being 7 days, which we did not receive – we therefore exercised the right to cancel this agreement under the Cooling Off period and a letter dated 7 April 2015 has therefore been sent to them by International Registered Express Post - we also emailed them a copy of this letter.
