Unwanted magazine subscriptions

M2 Media apparently does deals with other companies ("partners") to give out free magazine subscriptions. The first time I called,(a while back), I got a person who told there must have been a box I failed to uncheck when I bought something from from one of their partners, but she couldn't tell me which company it was.
Recently yet another mag started appearing in my mailbox so I called. There is now an automated message which includes a list of some of their "partners". I figure I'm getting these mags because of shoes I have ordered online from ShoeBuy.com.

I asked ShoeBuy.com and the agent there said it's certain brands of shoes that have this free mag "offer", not ShoeBuy itself. She told me that during the checkout process, there should be a box to uncheck that shows which magazine subscription will be sent.
I have made several purchases ("Cobb Hill" , "Softwalk" and "Springstep" shoes). I never saw a box and never knowingly gave permission for my personal information to be given to a magazine. And I have always made sure the "special offers" box from ShoeBuy is unchecked. Is this legal? Is it a privacy policy loophole?

I never would have imagined whole random magazine subscriptions as bulk junk mail. Maybe the whole idea is for the magazines to pad their circulation statistics so that they can charge more for advertising? And we just happen to end up being on the receiving end of the huge amounts of unwanted paper that is a result of the racket?

It's not enough to be told to "just unsubscribe" at cancelmag.com. I don't want spam/junk and I don't want my info hijacked onto more and more mailing lists.
