To You and each of you;
There is a conflict between you, Mr. Cooper (aka Nationstar) and me, Therese Daniels, a client of Mr. Cooper for the past several years over the issue of your unlawfully with holding Farmer's insurance money of $1885.13 in favor of OR Construction Inc. against my interests since October 2016. Let me emphasize I am a client in good standing while Or Construction is a third party vendor and was under my contract of which you had no position in the matter.
Let me bring to your attention your conduct towards me by with holding this money due me to delegate as I see fit is in violation and breach of your fiduciary duty and good faith business practices. You can be held liable for damages and penalties.
As evidenced by the chain of correspondence between us these past two years, which you have in my file, you have breached your fiduciary duty to me, your client in favor of Or Construction. You have exercised excessive control over my affairs, engaged in equitable or fraudulent conduct. You deliberately lied to me to induce me to sign the Farmer's insurance check first thus giving you control over money that was not yours to control. Proof and confirmation of my accusation is evidenced by the letter dated July 17, 2017 your representative, Mr. Manual Ramon sent to me stating
“. ... .WE DO NOT NEED A PAID IN FULL RECEIPT FROM THE CONTRACTOR AS WE DO NOT AND WILL NOT IN THE FUTURE COLLECT FROM CONTRACTORS IN REGARD TO CLAIMS.”
Believing you adhere to honesty and good faith business practice codes all business must follow, I took a chance and sent you the check which gave you control of money due to me.
Upon receipt of a check made out to Therese Daniels & OR Construction INC., I called the loss draft department. Including Or Construction Inc the check was not what I was told by Mr. Manual Ramon in his letter. This was a clear violation of the confidence and good faith I placed in his promise in his letter. I called your office and spoke to a customer representative who called herself “Allyson” to demand the check be reissued in my name only. Through lengthy discussions with many irritating holds, unkempt promises, about the “exceptions committee” and a second follow up call, I was once again told you would only do so if I produced a signed receipt of paid in full from OR Construction Inc. This was a direct contradiction to what was stated in the letter from Mr. Manual Ramon. It is now safe to say this letter was written to induce me to sign and send you the check upon false pretenses. This is fraud. Fraud including other misconduct by Mr. Cooper is a breach of honesty and good faith business practices for which there are severe legal consequences.
It is expected when a business operated within the honesty and good faith practices of the legal codes, it openly and honestly deals with a clients' complaint regarding the client's position and statements about its own company. In the two years of this persistent conflict between us, you have never once acknowledged the content of my complaints regarding your unauthorized determination to act as a collection agency for a non-client third party vendor. This is evidenced by the ridicules checky-box form letters that never acknowledge the long, tiresome letters and faxes I have sent to you listing the valid issues I have with you and Or Construction.
Ignoring my legal position and failing to do so is indeed a violation of honesty and good faith business practices as prescribed by the state laws, federal and state securities laws and even the RICO Act. Your conduct is outrageous, demeaning and offensive to be treated like this by you. After two years of bickering via telephone, letters and faxes you still do not have your final inspection. It is obvious your handling of this matter has not brought a solution to this matter. Don't you think it is time for you to honor my demand by reissuing a check made out to Therese Daniels with no other name on the check? Failure to do so may create far greater problems then already exist. Remember, this could have been resolved almost two years ago if it weren't for your obstinacy and breach of your fiduciary to your client.
I am seventy five year old senior citizen suffering from diabetes. I have been desperately fighting to bring my diabetes under control. Dealing with your conduct of excessive control via refusing to honor my request has been abusive and egregious to the point of causing me extreme aggravation. Extreme aggravation leads to extreme stress. Extreme stress causes deterioration to the healing process of sufferers of diabetes. Mr. Cooper's fraudulent and violation of good faith practice codes has contributed to the ill health I severely suffered these past two years.
“Any unlawful, unfair or fraudulent business act or practice...” (Business & Profession Code 17200 et seg). Penalty-- injunction: civil penalty up to $2500 per violation.
You want a final inspection of the Ridgemoor property. I want a check from you for $1885.13 made out in only my name. This is a simple and fair exchange. Due to your holding this check hostage you willingly conducted criminal, fraudulent and abusive acts against me. I made it very clear no inspection would be permitted unless I first receive the check from you and it is cleared at the bank. How can I ever trust you again after the way you deliberately lied in the July 17, 2017 letter?
I demand you reissue Check #1006401468 dated 8/22/17 for $1885.13 made out to Therese Daniels and Or Construction Inc. in the name of Therese Daniels only. Send it via over night directly to me at the above address by February 24, 2018. Failure to do so will motivate me to take the next legal steps which –in spite of all your lawyers—it will cost you legal fees penalties, fines, as much public embarrassment as possible from my publishing every where possible including FCC the nightmare experience I am having with you. I have prepared a strategic outline of procedures to initiate against you if I don't receive a check from you on said date. Don't make a mountain out of a mole hill. The law is on my side.
You do not need to call me. There is nothing more to discuss. Do not send another moronic checky-box el-cheapo form letter demanding an inspection for which I pay $35.00 while ignoring and avoiding the cause of this conflict and overwhelming correspondence we have shared. I will not acknowledge it. All you have to do to bring this to closure is send my check.
I notice there are over 600 complaints on the internet about Nationstar. Most of them are for lying. Is that why you changed your name from Nationstar to Mr. Cooper that rhymes with Pooper?
