SPS took over my sisters loan in 2013 as bad debt because Chase or anyone else hadn't collected on the loan since 2007 when my sister ran out of money from her husband's death benefit, when he died the day after the loan application was originated. The lender that originated the loan was indicted for $11 millions in mortgage fraud and my sister was a victim of their scam. SPS sent a letter that the loan was transferred from Chase to them. When I call Chase looking for assignment documents, they said sold the mortgage to SPS. SPS is like one of those collection agencies that buys bad debt and if they can collect the money it's their's to pocket. As soon as they took over I requested original assignment document that shows proof that WAMU/Chase owned the loan and that they had the right to collect on it. When I got the documents,there were no legal assignment documents that shows that this loan was endorsed over the WAMU/Chase. So I started researching the history of the loan. After the original lender was indicted,looks like WAMU just went to the county clerk office and got a copy of the note and mortgage and then sold mortgage back securities certificates to different investors in their name. One of this investor and their law firm tried to foreclosed on the property but they later dismissed the case because when ask to show discovery by my sister's lawyer, they refused to do it. So now SPS brought a loan that they thought was going to be easy to steal without having legal documents because this was a 70 senior citizen on a fix income , that they thought they could intimidate her into walking away from her home. They didn't count on me being there to help her and wasn't going to allow them to steal her house.They even offered her $10,000 to relocate. A lis pendens was placed on the property by the law firm and the investor, but all this activities with foreclosure and lis pendens was illegal because the investor was acquired by another bank in 2008 and these activities were done in 2010 and 2013. Right now SPS is claiming this lis pendens as an ongoing litigation which they think gives them right to hold on to the property by maintaining an escrow account. The last lis pendens was file and 2013 and legally a suit is suppose to follow right behind that and they must show that they have legal standing to make a claim on the property, which they don't have. Mind you this is the same investor and law firm that dismissed the case in 2011, now they are trying to make a claim on it again. There isn't one legal document that show that any of these lenders or investors funded this loan.It's been 8 years since anyone has collected on this loan and you would think if they had all the legal documents that they would have taken the house by now. It's not that a borrower doesn't owe money when he borrows it, it's that they doesn't owe it to any of the people who are trying to claim. I am working on filing a quiet title to get the illegal lis pendens removed and SPS to give up their claim to the property with the help of a lawyer. Usually this quiet title would remove lenders that's not suppose to be on the title report, but none of these lenders are listed on the title report. Once I can get the lis pendens removed, then pretty much this house will be free and clear from any liens. Take Control, don't let SPS intimidate you. Don't give up, if you are having problems with SPS you need to send them a QWR(qualified written request) to request original documents and to review your payment history. You can get a template for a QWR on the web. It's a law that SPS has to confirm that they received the letter in 5 days and they must send you all the documents and information requested in the QWR. ?Don't waste your time setting on the phone waiting for an answer that you aren't going to be satisfy. Communicate always in writing and need be if you still not getting your answers that you need, file as many complaints that you need to with the CFPB which will force them to
