Fraudsters

BTW: there are countries that arrest people who default on their bills. A bank collecting the money that is owed to them is not heartless, just business.

Sad to inform you that the bank, like many others, have the right to offset from a related account. That means the same financial institution as the debt. Unfortunately, if you are going to default on an account or loan, it is best to have a checking account at a different financial institution.

Fraudsters

I have been banking with Bank of America for years. I've had several
checking accounts with them as well as a couple of credit cards (one
personal and one business). I'm in California and am a home loan
officer by trade. Needless to say, the real estate market here has been
in the dumps for the last few years and I haven't made very much money
in the last 3 years. When all my income dried up, I managed to keep
paying all my bills and maintaining excellent credit for 2 years.
Finally in July of last year (2009), I just couldn't keep it up. I had
to stop paying my credit cards. This resulted in Bank of America
charging off the account back around April of this year.
I have
been squeaking by right now on about $700-1100/month. I'm even
collecting food stamps and my daughter and I are currently on Medi-Cal.
So my checking account rarely had more than a few hundred dollars in it
at any one time. I managed to put together a deal that netted me about
$2, 900 and I deposited it into my checking account and immediately used
it to start paying some bills, including my rent for July (I'm behind
right now). I deposited the check on Friday and on Monday there was an
$1, 144 debit in my account! They took everything except the checks that has already cleared and they left me with a
measly $100 in my account! This has caused me an extreme
financial hardship. My rent check was also written against this account
for $860. Now my rent check won't clear and my daughter and I
potentially could be living on the streets!

I
know in England, where our law of setoff descends from, they are not
allowed to take the money to satisfy a "non-priority" unsecured debt if
it causes hardship to the consumer in paying their "priority" bills
such as utilities, mortgage, rent, etc. - basic necessities to live
kind of stuff. Here in the United States though, the BIG Banks can do whatever they want even if it means putting families with children out on the streets!!!

Privacy Assist Scam

This has happened to me too...they have two service Bank of America privacy Assist and Bank of America privacy source.I enrolled for one and got enrolled in both unknowingly.I called up during the trial period to cancel it but the number was for bank of America privacy source. I was convinced that it has been cancelled. After few months I checked my credit card statement and got to know the other one was still active. They were charging me for quite a few months. I called them up to know why its still active and they said you need to cancel both separately.They told me they are two different departments doing almost same services to which I was amazed.When both are for same purpose why they have altogether two different services? They both have a similar name so I was easily confused that they are separate and not notified that they are charging me.It was absurd when I asked them to email all terms and conditions and whatever communication I am having with them to which they said no we cant do that since they dont have rights to do an email.What a heck ? Such a big company only working on phone communication and nothing in written to the customers.I think that's there key point to just keep it verbal so people can be trapped easily for selling this useless service.

Privacy Assist Scam

OMG i called this company after seeing a the charge on my bill, i checked and it had been happeining for a few months... i was so upset.. i found all these articles online about people who say they didnt say yes to the service...to make the story short.. i requested that they give me all my money or show me that i agree to it... obviously i didnt agree and i was really mad... well they played me the recording when i accepted the service.. now i wonder if this is what every one is so angry about... did we just agree and lost track??? after cancelling i went to their website, and their service isnt really that bad.. im thinking about getting it again.. i just feel ashamed to call and subscribe after the way i treated their employees and manager for something i did get... any one can give me a good suggestion... i may cosider

Account closure with no notification

I can care less about giving them my business or banking with them. I am talking about them just closing my account so i loose my points which if i transferred would come out to $1500. Where is the consumer protection they can just do that with every customer who has over a certain amount of points and that would make it ok? of course not and I am not the first person this happens to just like the over draft fee which they got sued for and lost $410M looks like they might have another case on their hands soon

Account closure with no notification

I have been banking with BOA for over 10 years and have the American Express card by BOA. I usually pay off our card each month because I use it for everything to accumulate points. With no advance warning my credit card was declined and when I called they stated it was closed due to but there was no reason why and i can call the account closure department. I have called and gone into local branches and no one can seem to help me other than directing me to call the account closures department. That department is simply a recording stating they are with other customers and stresses twice at the beginning and at the end that it is the BOA is not required to explain the reason for the closure. So basically they say leave your name and number and we will call you within 24 to 48 hours but it is their policy and they are not required to tell us anything. The worst thing is I have over 160, 000 points that I wAS saving and I cannot even access my points account because the card was closed and was told when I called that the points are usually forfieted when accounts are closed! REALY! I am moving the rest of my account to another bank and so will the rest of my family but I feel like something has to be done about this unfair business practice. Is this what i get for being a loyal customer

accounts closed without notice and world points lost

Same thing just happened to me I wanted to use my card and it declined when I called they told me my account has been closed for no reason and they gave me the number for the account closer. I had over 160, 000 points which they told me i lost. I have been with BOA for over 10 years and they do this out of no where. I always pay my balance off so they are defiantly not making money of off me and I think this is why they did that. I can care less about being with them and i am closing the rest of my account s and my whole family is moving their accounts to another bank institute. The only thing that is pissing me of is how i forfeit points which i earned and was saving. I really would like to report them for their fraud to a news agency or at least spread the word about their business practices. First they want to charge $5 for debt card fee and then when that didn't work they probably do this to their loyal customers in order to keep their profits high.

accounts closed without notice and world points lost

we received a letter Saturday that our checking account with BOA was going to be put on restriction in 21 days and closed in 30 and that it was a business decision. We have been banking with BOA for over 10 years and have the worldpoints card and all of our mortgages with them. We pay off our card each month because we use it for everything to accumulate points and use our points for gifts and vacation travel. That same saturday morning with no advance warning our credit card was declined and when we called they stated it was closed due to inactivity. which is totally false because as I said we use it for everything and had just used it the night before. Our credit score is well above 700. We have called and gone into local branches and no one can help us other than directing us to call the account closures department. That department is simply a recording stating they r busy with other customers and stresses twice at the beginning and at the end that it is the BOA is not required to explain the reason for the closure. So basically they say leave your name and number and we will call you within 24 to 48 hours but it is their policy and they are not required to tell us anything. We are also unable to access our funds locally. To make matters worse we have over 500, 000 worldpoints that we were saving for vacation and I cannot even access my worldpoints account because the card was closed and was told when I called that the points are usually forfieted when accounts are closed!!! We received a call from the account closures dept and they said they do not have to nor will they tell us why the accounts were closed and that our points are forfeited as per the credit card agreement and that there is nothing we can do!!! That is crazy!!! we earned those points!!!

You all enroll in the service by agreeing to it. Whether you are elderly or whatever lame excuses you give, and bottom line is you don't pay attention to what you are enrolling in and ignore terms and conditions is when you get burned. And who is to say that children with elderly parents know everything their parents do 24-7 is accurate is total BS. Now another thing, identity theft if now currently the #1 white collar crime in America, it is not hard to steal an identity. I bet your @$$ that if you had the service and became a victim you would be thrilled with the insurance they offer to cover your @$$ in court! The representatives from Privacy Assist are great well-educated people. And with every company there is someone that may be rude but should not label the whole company, but from my experience with the company, I have improved my credit rating and have been assisted by the wonderful representatives to dispute inaccuracies on my report. The young lady took 40 minutes of her time to assist me in helping and making sure I was comfortable with what I was dealing with credit wise. Word to the wise, if you don't wanna be treated like an @$$, don't act like one! Treat people good, and they will try to help you. Just saying. and as for the time frame for money to be put in account, Privacy Assist is a merchant, not part of the bank, they don't have the same systems, as with any other merchant there is a waiting period to receive refunds, don't give the reps from PA a hard time for it, It is not their doing how you enrolled, it is not their decision for time frames, and it is not their fault they can't cancel certain accounts without proper documentation! Idiots

Insurance Scam

In this tough economic times Bank of America is bulling homeowners into purchasing flood insurance in excess of their unpaid principal balance. In my case they went as far as to block the unused balance of my equity line. Even though I have had and outstanding record of payment for the last 4 years. My original equity line is for $60, 00. Unpaid principal balance of $34, xxx.00. I have always kept a flood insurance policy valued at the original amount of the loan. However, BOFA is now requesting that I increase the flood insurance to $250, 000.00.
This is excessive and unfair practice aimed at either making homeowners paid off their loan or lose their home to foreclosure.

Privacy Assist Scam

Hi, , writing from Bayamon, PR. BofA is doing still but now in PR. In March, 2011 my husband rec. mail with privacy assist logo. He opens, reads and then give me to file his mail. But he put it somewhere else at the time. In June, 2011 he rec. mail again. This time I am curious. The letter stated that to be able to release his credit statement he had to call and verify info. I checked back AMEX billing and lo and behold he had been billed 12.99 since April, 2011 including June. I called and indicated that there had been some mistake that at no time my husband had approved this billing and therefore this service. Still waiting for refund. I should have asked for my credit reports and then cancelled. In July I answered a phone call from BoA offering the same service, you can image how I ranted and raved. She ind. she could not image how this happended. I told her that my husband had a hearing problem/did not speak english well. That whoever called took advantage of his situation. Will be on the lookout.

Privacy Assist Scam

**DON"T BANK WITH BANK OF AMERICA!!!** I am writing this to inform EVERYONE - DON'T Bank with BoA! I am on my elderly father's accounts and recently I was checking something in the account when I came across $12.99 debit that stated "Privacy Assist Bank of America". I found this odd so I researched the past statements and found that it started in March 2009 at $12.99 every month. I know my dad didn't enroll in this, so I printed it out and gave it to him to go to the bank the next morning! He went there alright and was told by an EMPLOYEE " Someone tampered with your account" Yes, someone did tamper with the account- Bank of America tampered with the account! Later my dad told me what happened and I have never seen him this mad. He stated that he was going to close his account (an account he had since 2 banks before BoA took over). I went with him the next day to a different branch to close the accounts. That is when I learned that my dad was NOT refunded for the money they ILLEGALLY took out of his account. I had to ask for the refund and even then the banker seemed like he didn't want to help. He told us "that's a different department" As if I care that it's a different dept! Longer story short - Privacy Assist didn't want to refund all of the money. They told my dad "we did a service so we can't refund all of it". Well, I got on the phone and asked for a supervisor, but they wouldn't talk to me. So I told them "that's fine, but here's what I want to know..Why did you take the money that you had no authority to take? And what do you mean you won't give a full refund? What you did was illegal and I want the money back." Within minutes, they had agreed to give the full refund back. Do you think it ends there? NOPE! The banker told me that they would give the full amount back but it takes 7 - 10 DAYS to get the refund and the account has to be re-opened!! I agreed to that only because I wanted that refund. But have they never heard of electronic deposits? So they can electronically TAKE money without permission but they CAN'T electronically DEPOSIT they money back that they should never have taken! Also, why does the account have to be open? Mail a check - you are a bank - MAIL A CHECK!!
I think that BoA targets SENIOR CITIZENS by enrolling them fraudulantly in the Privact Assist. I think this because both my sister and I have checking accounts and neither one of us were "automatically enrolled" in Privacy Assist. Plus, I asked several times "How did this happen? How was my dad enrolled in this?" And every time I asked I was told a different answer. Some of the answers were "When your dad activated the debit card - that would activate it." Really - because if they had checked his record - he DOESN'T have a debit card and never had one!
Bank of America rips off their customers with the Privacy Assist! They DIDN'T give the refund that they said they would and when I called today I was given the run around again ! I get more running done when dealing with them that I do on a treadmill!! HA HA~ But seriously - BoA has NO RIGHT to have taken that money, NO RIGHT to have enrolled him in anything with his knowledge and approval, and most of all - they have NO RIGHT to take 7 - 10 days to refund what they took electronically and then they didn't even refund the full amount!!
Bottom line - DON'T BANK WITH BANK OF AMERICA!

Problems with flood insurance!

I have been dealing with the same flood insurance problems with BOA for several years. I own a lake front condo and our flood insurance is paid by the association using our condo fees. EVERY year I fax, mail, email and submit online the new policy and EVERY year they say they didn't receive it. Then they purchase a policy and stick it on my mortgage payment. I have spent more time on the phone trying to figure out what is going on in their system that they can't put my coverage information on file- it does no good! I have gotten many different "reasons" why this could be happening from fax machine problems to them saying there could be more units in the building than are on the policy (WHAT?!?). These people are crazy and I can't wait to be rid of them. Refinancing here I come.

Problems with flood insurance!

When our mortgage was sold to Bank of America, we were almost immediately told we would be required to carry flood insurance. I tried to communicate with customer service by phone and correspondence but was very much ignored. I was sold a flood insurance policy at over $600 per year. I tried to communicate with Bank of America asking why my property had been identified as being in a flood plain. I finally got a hold of someone in the second year of the flood insurance policy and was told by them that It was up to me to prove that I wasn't in a flood plain. I asked them where the proof was that I was and was ignored. Finally at the beginning of the third year I hired a surveyor who verified I was no where near a flood plain and I sent the report to Bank of America. Without so much as an apology they notified me that new information had surfaced about my property, that it was not in a flood plain. At that point I requested reimbursement for the two years of flood insurance and the cost of the survey, a total of about $1500. I never heard a word from them, not an apology, go jump in the lake, or any kind of a response. Rest assured if the shoe were on the other foot, I would have paid through the nose.

Home Modification Loan Program

I am in same boat with Mod process drug out ove r 3 years with 2nd Intent to Accelerate Letter Expired!!!
This is after having a Loan Mod APPROVED and signed and then being told 6 months later it was actually DENIED! Had to take money out of IRA to bring current, then told make plenty of money to make payment and fell behind again. Did NOT qualify again for Mod or Repayment Program- only 2 payments behind now!!!
PHONE CALL YESTERDAY CHANGED MY LIFE- MADER LAW GROUP- THEY R STOPPING FORECLOSURE BY NEGOTIATING A REPAYMENT PROGRAM I CAN AFFORD! THEY SAID THAT BOA WILL NEVER APPROVE A MODIFICATION OR REPAYMENT PROGRAM, THEY WANT YOU TO EITHER PAY IN FULL OR FORECLOSE!!! Thrust can also do a Midification for you if you qualify. PLEASE CHECK THEM OUT- I HAD THE FIRST GOID NIGHT'S SLEEP LAST NIGHT I HAVE HAD IN AT LEAST A YEAR!

Obvious rip off

TO WHOM HAVE MORTGAGE LOAN WITH BANK OF AMERICA, I BORROW MONEY ON MY HOME WITH CASH OUT BACK 7/2004 AMOUNT OF $120, 000 AND THE INTEREST RATE IS 6.4% MY PAYMENT IS $890.16 EACH MONTH I PAY HOME OWNER INS. AND THE PROPERTY TAX MY SELF. YOU WAS THINK OUT OF THE $890.16 SOME SHOULD GO TO INTEREST AND SOME WOULD GO TO PRINCIPAL, SINCE I HAVE THIS LOAN FOR 7 YEARS NOW, THE WHOLE AMOUNT TO TO INTEREST NOTHING GO TO PRINCIPAL EVERY MONTH, I CALL THEM, I EMAIL THEM, I FAX THEM, AND NOW THEIR JUST PLAYING GAME WITH ME. Obvious rip off

Juniper sold to B of A, couldn't pay either on-line as neither site would accept payment. Spoke with BofA "you don't owe anything this month." Today received call from a cred coll agency. They say I am in arrears. They want last month's payment which I sent to other creditors. NEVER BELIEVE THIS HOCKUM! I proceeded on my merry way and now have BofA claiming I missed a payment. I think this might be a scam. I'll send them the money due but I HATE the way they treated me..and so HATE THE BASTARDS...

BOA is a bunch of WICKED horrible, scheming, manipulative theives. I truly believe they have a secret code of ethics that was written by the DARK Lord. BANK OF AMERICA DOES NOT LIKE CUSTOMERS WHO HAVE LESS THAN SIX FIGURES IN THEIR BANK. Scam and lies

Bank of America credit card services lied about a repayment plan that was to have me pay a larger sum of money than I could really afford in order to have interest and late fees taken off my account if I reached a goal. Instead, when I reached the goal, none of the interest or late fees was removed. I made the increased payments for three more months with the credit card services people telling me to wait another month whenever I called.

I felt like I was being strung along and probably was while those who lied to me were getting reinforced to do so by bonuses and rewards for getting their stooge to pay more per month than should have been necessary.

I applaud your well put thoughts and SAD, every word is TRUE. Bank OF America is anything but. It should not be named as a Bank Representing Americans or for americans. They are wicked, deceitful and manipulative well taught theives. I don't like to harbor ill will toward anyone or anything but as far as BOA, I believe that they have a secret code of ethics that couldn't be made public because it would reveal their dark side for what it is.

Scam and stealing!

Bank of America is the worst bank in all directions of time and in every dimension. This is not an exaggeration, simply a fact! They do not credit erroneous charges even if one has proof. This has happened to me a couple of times with them. They are allegedly in bed with the Bonesmen and freemason society groups and will harass anyone if they dare say the truth about the awful business that they are!
Plus they will steal your money by not honoring the proof of the erroneous charges even when the business said they gave a credit. They are alleged thieves like Andy O'Niell who is President of Valley Bank in Helena Montana who closed my accounts for no reason other than to harass me, and then had the audacity to keep over two hundred dollars I had in one of my accounts. He is a liar and a thieve, and I BELIEVE he will soon be behind bars. And, I BELIEVE he ain't going to like the Helena jailhouse! You see Andy is on many boards that have to do with banking thru out the state of Montana. I wrote our banking committee in the Senate in regards to Andy but I believe they are just like him only in different skins! They have not helped me, and yes I do in fact sign part of their paycheck!

NSF Fees

BOA has had a class action law suit for this very behavior. They have had to settle this lawsuit but it didn't change anything. BOA is still at it. Their ability to find a reason to asssess a NSF to your account is perfected. Those babbling CSR's and their talking out of their a's excuses can get you so frustrated and angry because nothing they say makes any sense. I don't understand how they can continue such behavior. They are definately crooks. I have had 3 accounts all of which were linked together to pull if one got low but each time, they imposed a NSF without pulling from the 2nd or 3rd account. Each time the reps said they couldn't find where the accounts were linked and each time they went through the same process linking them and then next month, behold another list of NSF's. I am sure BOA is why I am now on blood pressure medicine. I'm changing as soon as I can.

NSF Fees

I believe BOA has charged me error on numerous occasions...Last Fri. 2/6 I made a couple of purchases, I realized I was in the negative so I made deposit by close of business day to cover the item pending which put in positive.

That Mon. 2/9 I needed unexpected auto repair. On 2/9 I was charged 2 $35.00 NSF for the item on Friday 2/6 & NSF of the transaction on Monday = 105. How is that possible. Let me mention I made a $200 on 2/10.

The Customer Service Rep and the Mgr. said b/c I swipped my card on 2/9 it caused them item on 2/6 to overdraw, even though I had the funds to cover the item on Friday. The mgr. went to say that 1) Funds must be available the day you swipe your card & 2) the day the merchant sends in the receipt.

Funny thing about that my account never shows me in the negative for the transactions done on Friday but yet I was charged $70 bucks which casued a ripple of affect so know I have incurred about $140 dollars worth of NSF fees.
