Wrongful Repossession/Deceptive Practices

My husband purchased a vehicle from DriveTime in November making bi weekly payments. On the Friday before New Years apparently they called "several" times to let us know there was a problem with his payment of $227. We never received this call because the tmobile spam filter blocked the robocall automatically. We go through the weekend with New Years day bein that Monday. So of course no phone call. Tuesday we are sitting in our liviing room and notice around 5 pm red tail lights in the drive way in front of his car. He immediately goes out thereto see a tow truck. A repossession agent had been dispatched on orders from Bridgecrest to repossess the vehicle due to an issue with 1 bi weekly payments. The repo agent says I'm. It sure what the problem is but I can wait to see of you guys can get this sorted out. He waited in our home on his own for over an hour and a half while we foolishly tried to get them to take the $227 hi weekly payment. They refused and said now $617 had to be paid ($270 repo fee + $125 storage fee) for a car still sitting in our driveway only blocked in. No lift no attachment or anything. The supervisor Dave we talked to in redemption told the repo agent to take the car even though we pleaded with them to take the $227. The following day we had to pay $645 to get The car back on top of the telling him that a payment was due in 2 days following.

Strangest thing though. When you login it said he only owed $54 and change with the next payment due date beiing 1/19/2018. You can't make a payment over the balance due. We took a screenshot. Went back in a few days later and took another. Somewhere between the evening of 1/8/2018 and the morning of 1/9/2018, they reversed 2 of the payments to talk g almost $600 which included the alleged missed payment. We call and get the runaround initially but were then told the payments were reversed and reapplied internally to cover the repo fees. We requested a transaction history and in 24 hours received the same information we could see online.the reversal and now disappearance of almost $600 with no explanation of where the funds went. Now they have made his account past due again and Bridget at Bridgecrest is threatening repossession again stating no wrong doing on their part.

This can't be legal!!! They took the vehicle when we could pay right then and now have taken funds internally which now makes him look past due and about to take the car again.if there is a class action suit...We are in!!! Email is [email protected].
