Breach of Contract, Owes me Money

I hired ICM to market and sell or rent my timeshare.
Then I actually sold it on my own to my mother and father in law - because ICM had not made any progress nor had they listed my property on their website as promised - .
Per the signed contract, any sell on my own or through another company within 20% of asking price was due a full refund of the marketing fee - $965 - .
I provided a Notarized Bill of Sale and the Title Transfer and the new Title and Property Deed in my mother and father in law's name.
Patrick Dunn - the Manager that had been assigned my file - said that because my mother and father in law were paying over the course of the year, I was not entitled to my refund until I could prove I got the whole asking price - unfortunately, I should have consulted an attorney then, because the contract is worded "ICM Marketing Group, Inc will refund my marketing fee if my timeshare sold within 20% of asking price upon proof of sale." and I provided LEGAL proof of sale! - Mr. Dunn said I had to show proof of funds received. So, he did refund 1/2 of my $965 saying I would be due the rest upon his confirmation of all payments received.
In Dec of this year, my in-laws made the final payment and I forwarded records of payments - cancelled checks - to Mr. Dunn in January of 2011. February 26, I called and was told by Alexis - the customer service manager - that my check would be issued in 90 days. I waited. In June, when I still did not have the check, I began to make calls.
I made 6 documented phone calls to ICM and Mr. Dunn and until I threatened to file a complaint - Mr. Dunn was always "unavailable". And no one returned a single call.
I finally got him to the phone today and he told me in a very unprofessional tone of voice that my file had been "cancelled" and that there was nothing he could do and that no check would be issued. He said, "You will never get your money back." He then told me, very rudely, he was looking for another job and that filing a complaint would do no good. I asked for the number to the president of his company, and he told me, "Good luck with that."
I have done beyond what is expected of me to get the remainder of my $965 and I have no other course of action but to file a complaint against Patrick Dunn and ICM Marketing Group.

Breach of Contract, Owes me Money

If this is such a great company, how is it that they took our money in May of 2010 and we haven't heard a peep out of them since despite the promise of imminent renters and buyers. This is a scam. The money you give them is close to the amount of the closing costs required to sell a timeshare and is supposed to be used to file papers. But I have received nothing to sign in that respect. They just take the money and run. We have come across a legitimate timeshare selling company who is not asking for our money up front, and who will pursue getting a refund from ICM Marketing of the monies paid them.
