On 1/24 I placed an order on Modnique.com website for 4 items totaling $245.44 - my credit card was charged in full on this same day. On 1/31 I placed another order for 4 items totaling $225.56 -my credit card was charged in full on this same day.
Per their website normal ship time is 10-14 days.
As of 2/18 I have not received anything from either of these orders. However, they have had for well over 2 weeks now, 3 of 4 items ready to ship from both orders.
I have contacted them via email & telephone numerous times asking them to please ship the items they have. They refuse to do this, yet they have charged my card & I am paying for them.
In addition, they can not provide any further status detail on the 2 items (1 from each order) that they have not received ye - so this could potentially go on for a long time!.
At some point they have to be liable to send me goods they have that I have paid for. (Right?) Are there any Consumer laws regarding charging a card for items not shipped or not in stock? Laws about how long a retailer has to send goods paid for once they receive them?
I want my items. I don't know what to do to get them to send me goods I've paid for!
