Dear Sir/Madam,

LETTER OF COMPLAINTS AND DEMAND FOR COMPENSATION - PHILIPPINE AIRLINE PR 1854.

We are Solicitors to Ms. Cleope Miraflor hereinafter referred to as “OUR CLIENT” and with whose instruction and mandate we herein write.

We are writing to you in connection with the above flight, on which our Client was booked to travel on Tuesday, the 9th day of January, 2018.

The flight was to depart from Mactan Cebu International Airport in Cebu, Philippines bound for Manila on January 9, 2018 at 2.30pm and arrive at 3:45 pm Manila Airport, with connecting flight to Qatar at 6:25 pm on the same day in order for our Client to board her connecting flight from Qatar to Lagos on January 10, 2018 at 2.30pm but her flight from Cebu to Manila via Philippine Airline PR 1854 was rescheduled from 2.30pm to 3.30pm resulting in a delay by One hour (1 hr.) which made our Client miss her connecting flight scheduled to leave by 6:25 pm from Manila to Qatar, then Qatar to Lagos, Nigeria and also her business appointment which had been scheduled in Lagos, Nigeria.

Our Client further informed us that she was now booked on an Ethiopian Airline to take her from Bangkok to Ethiopia and then to Lagos whose fare was cheaper than what our Client paid for her flight which she missed due to the delay caused by your airline.

Our Client informed us that despite the delay caused by the airline, the cheap flight she was put on, since the day she arrived in Nigeria, she is yet to receive her luggage containing her food supplements and important business documents which she was supposed to use for her business meetings which she was supposed to attend. She has made several calls to the airline requesting to know why she was yet to receive her luggage but she has been giving flimsy reasons until it was eventually confirmed to her that her luggage was yet to be picked up from Philippine Airline and was finally received by my Client eventually on January 18, 2018.





Kindly find attached copy of the data page of her International Passport, her ticket and receipt of purchase.

We now have our Client’s instructions to demand and we so do that within 7 days from the date of receipt of this Letter of Demand you refund the sum of $1,000.00 (One Thousand Dollars only) of the ticket she bought which she could not board anymore due to the delay from the airline and in addition she is also demanding a compensation in the sum of $5,000.00 (Five Thousand Dollars only) for the delay in her flight which resulted in her missing her connecting flight, the refusal of the airline to pick up her luggage to Nigeria where she had important business documents which had caused her some loss and not to be able to have access to her personal items.

Be informed that at your refusal to meet our Client’s demand, we shall take ALL steps available to us under the Law to recover the above sum from you both under the civil and criminal Law if same is not paid into their account at the expiration of this demand, whereat we shall include in our claims interest.
