1. Mr.Abhimanyu kumar and Mr.Susheel kumar the owners of M/s Preventine life care private limited , RPT house ,Plot 6 , sector 24 , Turbhe , Navi Mumbai : 400705 ( earlier , @ Alfa vista towers , Malad , Mumbai 400064 ) signed with me Memorandum of Understanding dated 5/1/2009 .Where in I was given the exclusive marketing rights for their products (present and new) for both Bangalore and Chennai. This agreement was done with a clause that, it will be cancelled mutually, where in both the parties agree upon .
2. As per the MOU, I was assigned the sales rights of Company for the services at Chennai and Bangalore on exclusive basis. I shall be getting 25 % commission on the sales generated in Bangalore and Chennai. I put enormous efforts for 3 years continuously and built a clientele consisting of several reputed hospitals at Chennai and Bangalore other hospitals, nursing homes and independent medical practitioners.
3. Mr.Abhimanyu Kumar & Mr Susheel kumar induced me in telling me that I shall have the sole marketing rights for all the present and future products of M/s preventine life care. They also induced me in spending my money on marketing activities in both Bangalore and Chennai and in spending money on the office electricity and sundry expenses incurred in running day to day expenses of the office both in Chennai and Bangalore. They induced me in spending lot of my money on marketing and other trade related activities. They induced me in making the agreement between them and the clients saying that any problem with the products they can handle legally with the client . They also induced me by saying that all payments collected by the team members both in Chennai and Bangalore should be deposited in their official account on a regular basis.
4. They promised me that I can easily earn Rs.5 lacs per month. They also told me that I shall get the entire marketing rights for the state of Karnataka and Tamilnadu .They told me that I shall be given the sole marketing rights for the entire south Indian market.They told me that since I have the exclusive marketing rights I shall be earning huge money as commission for the rest of my life.
5. I have generated a business of around Rs. 1,89,49,800/- (Rupees One Crore eighty fourty nine thousand and eight hundred rupees ) between January, 2011 to November, 2011 for the Company which no other business center has achieved. Initially , the Company paid me my commission till dec 2010 and paid part of jan to march 2011 . After that they started asking the data in different formats , so every time I fill the format and send them, it use to take some time , after this they started telling that they will give me 10% commission on all sales and not 25 % commission as agreed.They also told that they are deducting collateral etc which is against the agreement . They later started sending formats where in the formulas were wrong . this is clearly made with a intention to delay the payment .
6. During the same period I had got one big order from M/s lifecell international and here I am supposed to get Rs.150 per sample , More over I was negotiating with M/s lifecell international for a pan india business where in they have exclusive marketing right for PNBS ( product name ) .
7. Now that my commission had started to come in lacs per month , Both Mr . Abhimanyu kumar and Mr. Susheel kumar stopped communication with me , just to ensure that I don’t get this commission and to force me out of the exclusive marketing rights of Bangalore and Chennai, I have sent 40 email reminders on to all the concerned person and several phone calls , but they are not responding .
8. Therefore, Mr. Susheel Kumar Singh being the Director, Mr. Abhimanyu Kumar being the CEO have colluded and deceived by denying my legitimate payments of commission which is around Rs.30 lacs ( Rs.3000000.) till date .Also they have forced me out of the agreement and now i loose both the money and area rights. Now they have completed the deal for pan india operation with lifecell international , which i was working on.
9. I have also given a police complaint to additional commissioner Crime @ chennai . This case is now been investigated by, assistant commissioner of police , nungambakkam , Chennai.
