Bullnost on stairs is a trip hazard

Licensed contractor installed Shaw Industries composite flooring on stairs from first floor to basement. A "bullnose" was installed at the edge of the tread that is at least 3/16" higher than surface of the tread itself, creating a trip hazard. Contractor claims it meets the Virginia Residential Code and was installed per Shaw requirements. Local building code inspector agrees that it is a trip hazard, but the Virginia residential code allows it - but NOT the non-residential building code. My homeowner's insurance company USAA won't sent a licensed claims adjustor. I need a Certified Safety Professional and Licensed Architect to take this to Small Claims Court - UNLESS others have similar trip hazards to start a class action lawsuit.
