Fraud

Spirit Airlines charged me twice for the same flight. Called customer service and asked for a refund, twice a customer service representative assured me that it took 8-10 business days for therefund transaction. Did not happened. Called again, this time they said it a was a penalty and no refund can be expected? I asked why? Claimed they never recieved the payment, yet my credit card reflects both charges? Is this fraud legal?
