Fraud and Breach of Loan Modification
After 1 year we finally obtained loan modification documents from Select Portfolio Servicing Inc. We signed the documents and since we live in two states signed and had notarized 2 borrower signature pages. After making the 3 trial loan medication payments we submitted the signed and notarized loan modification documents back to SPS. In February 2016 they begin stating that the loan modification document were not received by January 6, 2016, although we have proof that they received the document via UPS. The placed a block on our account so that we could not make our Feb 2016 payment, so we mailed a check. They sent the check back saying the loan was in foreclosure status. We sent the check back they said to pay with certified funds. The asked us to sign another borrower page with both signatures, we did sent it back. Now that are stating that they did not receive the loan modification by the due date; but we did. During this period they sent out another offer for a new loan modification; we refused to sign and informed SPS that we intend to sue to make them perform pursuant to the loan modification agreement. And that we are not going to allow them to get away with breaching the loan modification contract.
