Auto Damage

My car was rear-ended by a policy holder of USAA. My car sustained a minor dent to the rear hatch along with the passenger corner of my bumper being crushed. I was not found at fault. I was contacted and arranged to take my 2012 Kia Sorrento to Caliber Collision in N. Salisbury MD. I drove my car with minor damaged and dropped it off. Eventually, I was connected with the TOTAL LOSS Department and worked out the details of the situation of my circumstance. USAA deemed my car as a TOTAL LOSS. Not totaled. It was explained that due to the value of the car ($7600), the estimate of repair ($4200) the cost of an auto rental (not advised of the amount) and the cost of Caliber Collisions price for storage (not provided)... Basically, I was told I could received a check for $7600 and sign over my car or I could keep my car and buy it back. I had several agents clarify several times that my car was not being totaled and it would not affect my title.... it would not be deemed a "salvaged" title. I could pick up my car from Caliber Collision and have my car fixed wherever I chose since the damage was only cosmetic. I called Caliber Collision, made arrangements to pick up my car. When I arrived at Caliber I was told I had to sign an agreement stating my car was no longer safe to drive. I kept asking everyone why it was no longer safe. I drove it there. The damage was only cosmetic. It didn't affect the integrity of the car??? Finally a man came out and said because USAA total lossed my car. I asked how did that make sense. What was it about the damage to my car that makes it not safe and again he kept saying because it was deemed a total loss. Again, I said the word total loss was based off a monetary amount, not the driving safety of the car or integrity of the car. He finally said well you bumper is damaged and if someone hit you again from behind it would do its intended job. I said ok- I can agree with that statement. I signed the papers; the lady handed me the keys and said have a good day. I stood thinking where is my car. I didn't see it out front for me to take home. I asked, where is my car and she said oh you have to go around back to the gated area and get it... um ok? So I walked around back and found my car sitting there in pieces... PIECES. The rear end was torn apart, the interior rear was torn apart... lights and everything was missing. My car had crayon writing all over it. Parts were ripped off my car and eventually placed in the back of my car. I was furious. I said someone needs to put my car back together. Eventually the same guy stated he would but for a fee. I called USAA and was told that I should have been advised the condition of my car had changed.. No one did this. I was then told that they were putting my rear lights back on so I could drive it but there weren't connected???? I was beside myself. My car was destroyed. What was minor damage was now an incredible amount of damage. Things were broken, missing and thrown all over my car. I drove my car home since I wasn't advised to bring a tow truck. When I got home I noticed the side panels had been dented and the front end had been hit and cracked. I have owned this car for 6 years since it was new and it was never damaged in front or the sides! This is unacceptable.
