CLASS ACTION LAWSUIT

---PLEASE ADD ME TO THE CLASS ACTION LAWSUIT---I got a 2007 Chevy Impala from Drivetime on Sahara in Las Vegas, NV 08/01/13. First they tried to sell me the car with a cracked windshield. They did not know I knew that was illegal. I advised them of the matter and they advised they would fix it if I was to leave it with them the next couple of days to meet their required inventory sales. (red flag). I did however as I had another vehicle I was using. I asked for a car report to make sure it had not been in any accidents. They advised me NO & also provided the contract that does not show any accidents. The warranty is useless as well as the customer service before it became Bridgecrest. The customer service would tell me to go back where I purchased the vehicle and the customer service by phone did not help explain the warranty as I came out of pocket for a few things that were covered in the warranty. Forget taking your car to chevy, drivetime wanted me to use their car repair place that charged an extra $60 for a diagnosis. There was no communication about the ignition recalls or any of the 2 recalls I had on my impala, found out by television and word of mouth. I have spent well over $3k in 3 years. What tops the cake for me is that I was on my way to work at 3am and my right axle broke coming off the freeway! I called and you would not believe not the 1 two reps did not even say are you alright and wanted to speak to me about why I was 2 days late! There is so much more, from recordings I have, faxes I sent, and still nothing. I will again have to come out of pocket to get a lawyer regarding the accident and why the axle broke when the car was never in an accident, but there is proof and reports- SHAME ON drivetime!---- PLEASE ADD ME TO THE CLASS ACTION LAW SUIT!

Shady bussiness

Drive Time sells used worn out vehicles for full price as if it is a new vehicle. Alot of the cars are damaged been in accidents and repaired and never reported to Car Fax!!!!! They know this and cover up and hide problems with the vehicle. They are selling junk as a new car and the buyer is being ripped off nothing is being done about them!!!

Lemon

I purchased a car two and half years ago. I have paid out almost 4 thousand dollars in repairs and growing. Recently the paint started coming off on the rear of the car and now it has expanded to the top and front. They make you buy the warranty which out of all the repairs only covered one thing. The warranty isn't useful at all and it is included in the monthly payment. I was trying to trade in the car, but since I owe so much money and the car is not worth1/3 of what I owe, it is impossible to trade it in. I am tired of the increasing expenses on the vehicle and now the appearance of the vehicle is making it even worth less. I would like to join the class action lawsuit.

Drive Time

I purchased a 2009 Pontiac G6 with 96,000 in November 2014. 16 months later it had total system failure. Estimated repairs would have cost over $3000. I had to trade in that car to the Chevolet Dealer ship and purchase a new car. Which in turn tacks on 9,999 to my over all loan. In other words I am still paying for the Drive Time car while financing the new car. I have own many cars in my life time. Every car I have owned lasted years not months. DriveTime

I purchased a 2007 Toyota Camry Hybrid June 1, 2015. the car had 91,000 miles and was being sold for 9000. because i had no credit and needed a car at that time i had no option but to get the car. it is now March 23, 2016, not even a year later, i have put about 10,000 miles on the car. I crunk my car up about a week ago, all my system lights came on, and two error messages popped up on my dash, one stated "Check Hybrid System", the other stated "Check VSC System." i turned the car off, came into the house and called Averex, the warranty company. Mind you this all happened on a Wednesday. Averex told me to make an appointment with DriveTime Repair shop, i called and was told the earliest appointment would be Tuesday of the next week, of course i took it, it was almost 7 and everyone else was closed. Thursday morning i woke up and called Sears Auto Repair which is a covered shop through the warranty, I told the person on the phone what was going on with my car and he told me that they were not Hybrid certified and therefore could not look at my car because it was a Hybrid Issue. I called DriveTime back to see if they were and they kept saying "oh we have to see the car to know whether or not we can service it." Again this was Thursday and my appointment wasn't until Tuesday, finally someone told me they weren't. I cancelled the appointment and called the Warranty company back. The sent me to another shop that was could actually look at the car, i called them and was told I could bring it in on Monday. Monday gets here I am at the shop at 8 am. I drop my car off and leave, 3 pm i receive a call from the shop informing me that a $3,000 repair is needed and the warranty isn't covering any of it. My hybrid system failed and would need to be replaced, after it was replaced the computer would have to be reset and it would take about two days of labor. I call DriveTime about this because a 3k repair on a 9k car is completely unacceptable. This is all happening as stated on Monday.I speak to several agents, finally i talk to someone who tells me they would send this to management to see if they can help with the repair, they said it would take 24 to 48 hours to get a decision. It is now Wednesday, the day that I have to pick my car up from the repair shop where it has been sitting, or bring in some money to begin the work, i have not heard from DriveTime, i call them and am told that my "claim" had never been processed and it would take another 24 to 48 hours to process, putting a decision at Friday, the latest. I express my frustration and am told I can call in this time tomorrow with a decision. Once payment has been made it is going to take 4 days for the shop to receive the parts needed plus two days of labor. not including weekends on any of that. If i were to get a decision on Thursday, my part would be here on Wednesday, the car could potentially be ready on Friday which means I am paying for a rental car for 2.5 weeks while possibly paying half of the repair. This is absurd, i have not had the car for a full year yet and this is clearly something that they would have known upon buying the car. I have missed school due to not having a car and they do not seem to care about any of that, during this whole thing a car note has been withdrawn from account although they are aware that the car is not in drivable condition. Buying a car from DriveTime was the biggest mistake of my life.

LIES

This company failed to file registration paperwork for my car resulting in tickets and fines. I brought the tickets to them after repeated calls before the temp tags expired and they promised to pay the fines. NEVER PAID. Now we have court fines and warrants! I've been fighting this company for a year! I need help asap!

False and misleading Information and triple the vlaue of cars

I brought a 2008 Chevrolet HHR It had 66.900 Mile on it,the value of the car is $9000 over the value I purchase the vehicle and the wheels on it was bad and the warrant did not cover the parts and labor so I had to take to another automotive to get fix also there was hidden fees that Drive time put in there contract like gap and a tracker device on the vehicle. and they also changed $7.12 accrues daily interest on the loan I never hear of a car loan company charging a daily interest rate on a loan before. This is such a bad company the IRS and Attorney General needs to investigate this company now. The consumers report needs everybody to know about this company. It is such a big rip-off to people that is trying to do the right thing in getting there credit straighten out and the prey on the less than perfect credit please help us consumers to get this company closed.

Class action lawsuit

I purchased a 2011 nissan quest from drive time, in april of 2015.Like most others the car gave me problems from the beginning with a promise that the warranty would cover all defects, i spoke to someone at drive time a few days after my purchase, because the car was stalling, i was told to take it to the mechanic, and that they would take care of it. The last straw for me was when my car just turned off in the middle of traffic with my family in it, we tried to start the car back up, but nothing seemed to work, i immediately called them, and i was told that " I could have it towed if i wanted to!"the previous problems were never fixed, they kept dragging them, until the warranty was invalid, and then told me that the warranty was over, even though i had addressed the problems several weeks prior. I was told that nothing could be done on their part so i was forced to pay (out of pocket) for a brand new battery. Keep in mind i hadn't had the car for a month before the problem occurred. I noticed, a noise in the brakes when i purchased the vehicle, and told them about it, they told me that it would stop over time, and i had no choice, but to wait the noise eventually got extremely bad, and they again would not do anything, so i had to pay for new brakes, shocks, and struts, because according to pep boys they were in horrible condition. several people have lost a lot of money with this company, and it is not right that they get away with it. my newest, and most costly problem is that the car smokes horribly. i then thought it would be a good idea to purchase a protection plan for the car. i took the car to the nissan dealership in my area, and they told me that the ENGINE WAS SLUGGED, and that was what was causing the smoking. they also told me that the only way to fix it was to get a new engine! I was also told that this problem was pre existing, and that the engine had been like that for quite a while, and it was due to the previous owners neglect, and due to this my plan would not cover its repairs. i took it drive Time once again and they told me that they would cover the repairs, when i took it in they said it was due to me filling the oil too much, which didn't make sense, but i figured i would let them take whatever process they wanted as long as my vehicle was taken care of. Yet again Drive time found another reason not to fix my car, they told me that they already paid for the oil flush, and that was what they told me they would cover, which was not the case At all. So now i am stuck with a useless car that i have to make payments for because if i don't it will Ruin my credit, and i cannot afford that. Drive times carelessness, and lack of respect, and consideration for its customers is one of the worst i have seen with any company, and i will pursue this matter by any means. i work hard to make ever dollar i have, and it is being stolen from me by this company.

Defective Vehicle

I believe another lawsuit should be PRAGMATIC! All consumers need to know and who have/had bad experiences with Drive Time on receiving an unsafe vehicle and refusing to take responsibility on repairs their warranty is not upheld.

I find that Drive Time's deceptive advertising and sales practices, which I feel endangers the lives of their customers, their families, other passengers, and everyone who shares the roads.

I purchased a car through DriveTime on November 4, 2015, it a lease to own vehicle. It's a 2008 Saturn Aura. I started having issues recently with the car I recently purchased and filed a claim due to the mechanical issues I was having. I needed to file this claim before December 4, 2015, due to the expiration of my warranty. I was sent to Boyd's Goodyear at 44 E. Schrock Road (614-895-5665). I was hit hard by the news about what is going on with the vehicle.

• Sway Bar Links bad causing popping noises
• Idler pulley bad causing noise under hood; rough idling
• Power Steering issues; But Idler Pulley needs to be replaced first
• Left Rear TPMS Sensor has a dead battery
• Transmission has a code stored with regards to shifting problem(s)
• Has a foul odor coming from somewhere under the hood; which the mechanic claimed he didn’t smell
• NO CHECK ENGINE OF EXISTING ISSUES AND WHY?

I only had this car for exactly a month and these issues didn't just appear. I feel that I was sold an unsafe car. Because I went over the 1,500 mile limit according to the 30 Warranty they denied my claim and told me I am responsible for the repairs.

I had to pay $153.00 to get this vehicle back from the mechanic. So far, the cost is estimated at $627.42 parts and labor for some of the issues leaving more to come with additional charges for transmission work that I simply don't have.

I took the car back to DriveTime (Morse Road Location) and hand them the keys back. I told them I will not make payments to this vehicle due to the issues I am having.

I don't know if DriveTime is considered a 5-Star Certified Service Center but this vehicle should not have been on the lot for leasing or financing. I was told at the time of purchase that their service department checks every car before it's put out on the lot to be sold. This however I feel was not the case with the car I purchased a month ago.

What would have happened if my husband and I were in an accident due to these mechanical problems, whose fault would it be?

I am very very upset with this. It took the Customer Relations Department 24 hours to address this matter and still it will take another 24 to 48 hours to decide if they can give some kind of assistance for the repairs. To Date as of 12/10/15, I still have not heard anything from this company.

I researched and found that this vehicle has 12 Recalls. Another reality that this vehicle is valued around $6,500.00 (if in descent condition) according to Kelley Blue Book; yet you are charging me $14,900.00 for a “USED” vehicle.

I don't want this car nor any other car from DriveTime; this will be my last experience with this company. Again, I feel that they are selling cars that are mechanically unsafe and I would hate for anyone else to go through what I am going through. DriveTIme needs to take accountability for their actions.

Just a brief mention, having a conversation something surfaced and I think it should be mentioned as well; individuals though working, have the worse credit but somehow happen to get a new vehicle; and NOT through the leasing so-call program. I guess it’s depends on “WHO YOU KNOW.”

All I request is that this contract be voided; the car junked and for a refund of $153.00 that had to come out of my bill money for the diagnostic test which should have been completed prior to DriveTime putting this car on the lot.

DriveTime

I been leasing a vehicle through drive time for almost a month now. The brakes started squeaking the second day I had the vehicle and has not stop and it's been about a month, the service engine soon light came on, the second week I had the vehicle I had the oil checked and I was told that the vehicle didn't have any oil in it at all and the filter was very very very dirty, the vehicle had a very very very very I repeat very bad smell on the inside! I paid 75 dollars to get it detailed and the smell was still there!

Charge off older than physical repossession

I bought a car from Drive Time after divorce in 2013. Made payments fairly regular at first then fell behind for one reason or another, but caught up. This happen ended a few times but I always communicated with them. For most part they were understanding and helpful until recent. They put an order of repossession in August of 2014 and per said if I paid $1000+ it would bring me current and stop the repossession. I did. Things seemed to go ok. Then I fell ill after surgery and missed payments. I still attpted in good faith to make payments but missed more. Meanwhile I'm trying to save money for a major repair that I think was always needed even when purchased-power steering leak that kept getting worse. Remember-Car also had problems from day one; headlamps, interior pieces falling off, AC not working properly and then lastly the Piwer steering (see above). I then fell ill after surgery and when I finally recovered was back to work trying to catch up on delayed payments. I signed up Wedtern Union Pay (option of Drive Time) and kept getting texts no payment due so I thought they were helping me get back to work so I could do OT to get current. One day July 2015 early at 530 am I was going in for OT and my car was gone. I researched and found out it was picked up. This was after getting all these texts of no payment due. Go to try and get a car July 2015 and am told DRIVE TIME CHARGED OFF MY VEHICLE IN SEPT 2014 while I still made sporadic payments and still had procession of the car (until July) when I could due to my issues. So when I could make payments who was I making them to using Western Union pay or CheckFree with WalMart or Ace. Anyhow the harassed me with call for the longest until they just stopped. What recourse go I have regarding this rip off company???!!!

Drivetime warranty

First let me say I was an employee of DT in 2007 and left their employment on good terms in 2010. I worked in the customer service department. I had purchased a vehicle thru their employee purchase program & I was given a 90 day standard warranty. When I noticed there was something wrong with the transmission: an occasional hesitation- just before my warranty was up, they outsourced me to a 3rd party repair facility they had contracted with. They said "yes" something is definitely wrong with your transmission and will need to be completely replaced. I thought "whew" I'm glad I'm still under warranty. The Transmission company replaced my transmission and at no cost to me. Then 2 1/2 more years into owning the vehicle the transmission went out again - specifically the reverse clutch pack. I had since left DT & relocated to a state they did not service and they didn't have a facility they were contracted with in my new state. I was told that my vehicle was no longer under warranty so it would be my responsibility to replace the transmission. They offered me hopes of a repair contract but said I would need to pay for the repair first, submit my receipt and they would defer my payments in equal to the amount of the repair.By the way, the interest continues to accrue on deferred payments. My account was 2 payments behind (due to missed work for a vehicle I couldn't drive, and having to pay for rides) So I would also need to bring my account current in order to qualify for the repair contract. A new transmission would have cost me approximately $2500 to $3000. I only had $1700 left on my auto loan with them. I asked DT - what about the company they used to replace the transmission in the first place, it shouldn't have gone out in 2 1/2 years. Wasn't there any recourse? I was told "No" I'm left to wonder if the transmission was ever replaced at all. The collection department called me 2 to 3 times a day as well as my references. Each time I spoke to an account representative I told them I'm trying to work on a repair contract with the other department they said that was fine but I needed to make my payments regardless of the situation. I know the collection employees are paid monthly bonuses for each dollar they collect on past due accounts - this leads to aggressive and rude collection tactics by DT employees. I enjoyed working for DT but was seriously disappointed in the way they handled my account.

DriveTime

I purchased a Dodge Grand Caravan back in 2013 and a month later started having a problem with the tire and so forth so I took it back and they fought and argued on fixing that well then about two months later the change oil light came on and so I took it to Walmart to have the oil changed and when I did they told me that they couldn't change the oil because the oil plug was stripped out and I couldn't do anything about it so I called Drive time and then filed a complaint with the BBB.org and then with the attorney general and after I did that that in I spoke to Hollyhondro and he said that for me to fix the problem and then send them a receipt and they would take care of the payments for the three months well I assumed that they did well then August 1,2014 I got online and tried to make my payment and they wouldn't except it and then not to mention back in late June they closed my account without notifying me or anything and now they are threatening me to repose my vehicle so now I am trying to find other people that has had trouble with Drive time to please contact me because I am planning on taking them to court about this my name is Vicky Ernst and my telephone number is 513-802-0110

Drivetime

I bought a car from drive time in mid 2012. As they told me my credit was bad and couldn't go to a dealership without more down. Shortly after purchase I reported the wrench light was on ( 2006 ford freestyle) within the third week of driving. Was sent to a dealership for a ford recall and had some piece cleaned that was something with the eg?. Not to car savvy. Reported the car was not driving and would go to safe mode after driving 16 miles. I told them to come get it after being harassed for payment in 2013 as I couldn't afford the car as I purchased a brand new one (2012 ford fiesta) from dealership due to theirs not working. They stated they would work with me and they sent me to their service department as it was under warranty. I explained there was not a shop within 50 miles of my house and towing was expensive ($70). The warranty company sent me to a shop in San Antonio. I signed to have the work done (150 deductible due to how long I had had the car and not the miles as I barely drove it due to issues) They called me stating they fixed the AC (wasn't broken) and that I would need to have it towed to a Transmission shop (another 150 deductible) for that shop. While I was there the owner had his shop full of cars from drivetime. He stated the transmission was probably bad when I bought the car due to the transmission belt type. I tried to call them and work out getting it caught up , I thought I might give it to my teenager....but they kept haggling me for more money to supposedly reach this magic amount that let the payments roll to the end of a note that was way more than the value of the vehicle.

In the meantime we bought another car for my daughter, offered to sell the car (total laugh at that). Til finally after having to explain myself monthly to a new person ; who couldn't read the notes on my account; the two year ordeal I told them to come and get it. This week they finally came for it , 2 months later after calling me 4 times a day as well as family etc. The wrecker service was a great guy, just doing his job. He laughed as the car was cleaned out and ready when he got to the house. He advised me to look up DT class action lawsuits to at least attempt to make a difference. He stated he was advising everyone he picked up for them the same.

I hope this helps you. By the way I received no written notice of pickup or late payments. Just phone calls and when I called. (I have phone records by the way as they continually stated I was not calling in. I had to tell them ...do you see the payment in western union...I called in....real Einsteins they are.

SIGN UP FOR CLASS ACTION LAWSUIT

I've had my car for 4 months. Since day 1 the turning signals work when they want & my saleslady said it would be fixed by warranty since it was a safety issue. I am still fighting to this day to get this fixed. now my car is in the shop for a motor mount, pulleys and a list of other things including bearings in which they are fighting me to cover! this place is shady & i literally want to drive it through the corporate building. they call me everyday to collect payment even though they said they could defer 2 payments so i could fix it myself. i hate this place & they are making my life a living hell. i literally dont even care if they take it back & it goes on my credit. save me the hassle everyday!
